Article 1 - SCOPE OF APPLICATION
These terms and conditions of sale (the "Terms and Conditions") apply to the sale of products marketed by Valkyrie Paris (the "Products") to any individual or legal entity wishing to benefit therefrom (the "Customer"). Products offered on the site www.valkyrieparis-bijoux.fr operated and published by Valkyrie Paris.
The General Terms and Conditions notably stipulate the conditions of purchase, payment and delivery of Products ordered by the Customer. The Customer may refer to the description of each Product appearing in the Valkyrie Paris catalog to find out its characteristics.
Placing an order for Products implies the Customer's prior acceptance, without restriction or reservation, of the General Terms and Conditions, which the Customer declares to have read.
The General Conditions are applicable subject to any stipulation to the contrary appearing on the order form or in any special conditions concluded between Valkyrie Paris and the Customer concerned.
The General Terms and Conditions are without prejudice to applicable legal provisions, in particular those set out in the French Consumer Code.
The Customer acknowledges having read and expressly accepted the General Terms and Conditions of Sale in force on the day of the Order, prior to placing an Order on the Site. Acceptance of the General Terms and Conditions of Sale is effected by the validation of the Order by the Customer. By proceeding to payment, the user indicates his unreserved acceptance of these terms and conditions. These conditions are the only ones applicable and prevail over all other conditions.
Article 2 - PRODUCTS AND AVAILABILITY
The price and essential characteristics of each Product are described in the Valkyrie Paris catalog and published, as the case may be, by the Seller or its suppliers. Descriptions may include indications, photographs and graphics which are provided for illustrative purposes only and may be modified/updated by Valkyrie Paris.
The Products offered comply with French legislation and European CE standards in force at the time the order is placed.
The fact that Valkyrie Paris presents Products in its catalog does not constitute an obligation to market them, particularly in the event of stock shortage, unavailability of Products or the impossibility of marketing said Products, for whatever reason.
In the event that one or more Products are unavailable following the placing of an order, Valkyrie Paris will inform the Customer in writing of the waiting period for receipt of the temporarily unavailable Product. In this case :
- the Vendor may, with the Customer's agreement, offer a product identical to the one initially ordered at the same price. In this case, the Vendor will bear the cost of returning the product in question;
- the Customer will have the choice of waiting for the missing Product(s) to become available in order to receive the entire order in a single shipment;
- the Customer may cancel the order in its entirety; or
- the Customer will be able to cancel the order of the unavailable Product(s) and thus receive the other Products in the order within the announced deadlines.
In the last two cases, and where the Customer has already made a payment, he will be reimbursed in the same way as if he had exercised his right of withdrawal.
Article 3 - ORDERS
3.1 Placing an order
Any Customer wishing to place an order with Valkyrie Paris must complete and sign an order form summarizing, in particular, the essential characteristics of the Product(s) ordered, the total price, the terms of payment, the delivery time or duration, any delivery restrictions, a tracking number for the Customer's order and the terms and conditions for exercising the right of withdrawal, where applicable.
Confirmation of the order takes place upon signature of the order form by Valkyrie Paris or the sending by the latter of an e-mail confirming the order, the order thus becoming firm and definitive, subject however to the possible application of the Customer's right of withdrawal.
No order may therefore be modified or cancelled without prior written agreement between the Vendor and the Customer.
3.2 Controls
Each Customer guarantees the sincerity and accuracy of the information provided for the purposes of his/her order and undertakes to notify Valkyrie Paris of any changes.
Valkyrie Paris also reserves the right not to accept or to cancel the order of any Customer who has provided incorrect information, who has not paid for the Products, with whom there is a dispute relating to the payment of a previous order or who has an abnormally high level of orders.
The customer must take care to ensure that his or her personal details are recorded accurately. Valkyrie Paris shall not be held liable in the event of impossibility to deliver the product due to an error by the customer in the registration of his personal data.
Valkyrie Paris is not responsible for verifying the customer's identity.
Article 4 - RATE CONDITIONS
The Products are sold at the Valkyrie Paris catalog price in force on the day the order form is signed, expressed in euros and inclusive of all taxes (French value-added tax and other taxes applicable on the day the order is registered).
Prices are firm and non-revisable during their period of validity.
Any charges for transport, delivery, order processing (postage, packaging, preparation of the parcel, optional services subscribed to by the Customer) and other charges, interest and commissions are indicated on the order form and are established according to the place and method of delivery selected by the Customer, as well as the type of Product and/or the quantity of Products ordered by the Customer.
If the Products are not received by the Customer and must be reshipped, the Customer may be billed for additional processing, shipping, transport and delivery costs under the same conditions as those set out on the order form.
Valkyrie Paris reserves the right to modify its prices at any time for any Products ordered after such modification.
Price reductions, rebates and discounts may apply to Products under the conditions set forth in the Valkyrie Paris catalog or in any other document communicated to the Customer. In the event of a promotional price, Valkyrie Paris undertakes to apply this price to all orders placed during the promotional period.
Any change in prices resulting from an increase in value-added tax or the creation of any new tax based on the price of the Products will be immediately and automatically applied.
Article 5 - CONDITIONS OF INVOICING AND PAYMENT
Products are invoiced and the price is due in full and payable in cash on the day the order form is signed.
All payments are made by credit card.
Upon payment of the agreed amount in accordance with the conditions set out in this article, Valkyrie Paris will send the Customer a payment confirmation e-mail to the e-mail address provided by the Customer.
Article 6 - DELIVERY OF PRODUCTS
6.1 Delivery
The Products ordered by the Customer will not be delivered until the Customer has actually paid the amount referred to in article 5 above.
● Product shipping and delivery times and conditions
Upon confirmation of the order and payment by the Customer, the Products will be shipped by the method, to the address and within the delivery period indicated on the order form, together with the corresponding invoice.
In the event of delivery outside mainland France, the Customer shall be deemed to be the importer of the Products and shall be bound by the regulations of the country of delivery, it being specified that cross-border deliveries may be subject to opening and inspection by the customs authorities.
As soon as the order is dispatched, Valkyrie Paris will send the Customer an e-mail confirming the dispatch of the order and including, where applicable, the tracking number of the parcel so that the status of the delivery can be ascertained.
Products ordered may be delivered in one or more separate shipments.
In accordance with the provisions of article L 121-20-3 of the French Consumer Code, Valkyrie Paris products ordered are delivered, insofar as stocks are available, within the times indicated on the site from the time the order is validated.
The customer will be informed of any delay in delivery of which Valkyrie Paris is aware.
Your order will be delivered to the address communicated to Valkyrie Paris at the time of your purchase.
Deliveries are made by Colissimo and LaPoste for international deliveries. Delivery is free in Metropolitan France, and a fixed charge of 4.95 euros applies to international deliveries.
In France, customers receive their parcels within 2 to 5 working days of dispatch.
Order processing can take up to 8-10 days if sizing is required.
● Delivery to specific addresses
When delivery is made to a collective address, the Customer acknowledges that the order is delivered to the collective address indicated on the order form.
When delivery is made to certain areas that are difficult to access, delivery may be made to the nearest delivery center or to the final address by a carrier independent of the carrier used by the Seller, at the Customer's expense.
● Absence on delivery
In the case of delivery by "La Poste", the Customer who is absent at the time of delivery has a certain period of time, specified on the delivery note issued by "La Poste", to collect the parcel from the post office indicated.
After this period, the parcel will be returned to the Vendor's logistics department. The Vendor will inform the Customer of this, it being specified that in the absence of a response from the Customer within 7 days, the Vendor will consider that the Customer has exercised his right of withdrawal.
● Delays and errors in delivery
Valkyrie Paris cannot be held responsible for delays in delivery due to postal services or carriers.
However, in the event of late delivery of the Products, for any reason other than force majeure or the fault of the Customer, the Customer may cancel the order under the conditions set out in Articles L.216-2, L.216-3 and L.241-4 of the French Consumer Code, after having requested the Vendor to make delivery within a reasonable additional period.
The sums advanced by the Customer will then be returned to him.
The Customer also undertakes to inform Valkyrie Paris of any non-delivery within 15 days following receipt of the e-mail confirming shipment of the order, so that the Vendor can, if necessary, assist the Customer in taking the appropriate steps with the carriers.
Furthermore, in the event of a delivery error resulting from the Customer's communication of inaccurate information (delivery location, accessibility of the location or any other problem) leading to the need to make a new delivery, the related costs will be invoiced to the Customer.
6.2 Conformity of delivery
Valkyrie Paris shall be obliged to take back the Products in the event of delivery of Products damaged on delivery.
In this respect, the Customer is required to check the condition of the parcel and the Products on receipt and to make any necessary reservations on the delivery note, co-signed by the carrier, in the event of deterioration of the Products on delivery.
Any reservations must be notified immediately to the Seller within 15 calendar days of delivery.
Valkyrie Paris will validate the return request and will assume the shipping costs.
The Customer must return the non-conforming Product to Valkyrie Paris under the conditions stipulated for the right of withdrawal.
If this procedure is not followed, the Customer will no longer be able to make a claim concerning the conformity of the delivery of the Product.
Article 7 - MARKETING OF GIFT CARDS
By purchasing or using a gift card, you agree to these terms and conditions.
7.1 Gift card features
- Gift cards are available in amounts that can be customized by the customer, from 100 euros to 1,500 euros (in increments).

- La carte cadeau est valable pendant 1 an à compter de la date d’achat.
- Les cartes cadeaux peuvent être utilisées plusieurs fois jusqu’à épuisement du montant crédité.

- Carte physique : expédiée à l’adresse postale du bénéficiaire ou à celle de l’acheteur pour lui offrir. Délai de livraison : 3 jours ouvrés.
- Carte virtuelle : envoyée immédiatement à l’adresse e-mail du bénéficiaire.
- Gift cards are not reloadable.
7.2 Marketing methods
- Gift cards are sold exclusively online, via the Valkyrie Bijoux website.
- Payment methods accepted: payment by credit card via a secure payment link. Once the gift card request has been made using the form provided, Valkyrie Bijoux will contact the customer to finalize the transaction.
7.3 Refund, exchange and cancellation conditions
- Refunds: Gift cards are non-refundable, except in the case of legal non-compliance.
- Exchange: Items purchased with a gift card may be exchanged, but cannot be refunded.
- Annulation : Une fois l’achat de la carte cadeau finalisé, l’opération ne peut être annulée.
- Perte ou vol : En cas de perte ou de vol de la carte cadeau, Valkyrie Bijoux offre la possibilité de générer un nouveau code confidentiel lié à la carte cadeau, sous réserve que le client puisse fournir une preuve de l’achat de la carte et apporter une preuve suffisante du vol ou de la perte. Les demandes seront étudiées au cas par cas, et Valkyrie Bijoux se réserve le droit de refuser une telle demande si les preuves fournies ne sont pas jugées suffisantes.
7.4 Liability
Valkyrie Bijoux décline toute responsabilité en cas de mauvaise utilisation de la carte cadeau par le bénéficiaire ou de perte des données de la carte (code d’activation, e-mail, etc.).
7.5 Applicable law and disputes
- Applicable law: These terms and conditions are governed by French law.
- Médiation : En cas de litige, le client a la possibilité de recourir à une médiation conventionnelle ou à tout autre mode alternatif de règlement des différends. Valkyrie Bijoux s’engage à examiner toute demande de médiation.
- Tribunaux compétents : Tout litige relatif à l’interprétation, l’exécution ou la rupture des présentes CGV sera soumis à la compétence des tribunaux français.
7.6 Protection of personal data
- Valkyrie Bijoux s’engage à protéger les données personnelles collectées lors de l’achat des cartes cadeaux conformément à la législation en vigueur (RGPD). Les informations personnelles des clients sont utilisées uniquement pour le traitement des commandes de cartes cadeaux et ne sont en aucun cas divulguées à des tiers sans consentement préalable.
7.7 Special conditions
- Les cartes cadeaux ne peuvent pas être utilisées pour acheter d’autres cartes cadeaux.
- Items purchased with a gift card are exchangeable but non-refundable, in accordance with the above conditions.
Article 8 - RESERVATION OF TITLE AND TRANSFER OF RISK
In any event, Valkyrie Paris retains full and complete ownership of the Products until the Customer has fulfilled all of its obligations, and in particular until the price of the Products has been paid in full.
The risks are borne by the Customer from the moment the Products are first presented at the delivery address(es) indicated by the Customer (including collective addresses). Delivery of the Products is deemed to have taken place on the date of first presentation of the Products at the delivery address indicated by the Customer at the time of ordering.
The exception to this rule is when the Customer has chosen to use a carrier designated by the Customer, in which case the transfer of risk occurs when the Products are handed over by the Seller to the carrier designated by the Customer.
Article 9 - RIGHT OF WITHDRAWAL: RETURN AND REFUND
If the customer is not entirely satisfied with the Valkyrie Paris products, he or she has a right of withdrawal of 15 days from the date of receipt of the order to return one or more products in the order.
If the order is not returned within the allotted time, the order will be deemed final and no refund will be possible.
No refunds will be given for jewelry sold out.
Le retour sera accepté seulement si le produit retourné est dans son état d’origine. Aucun bijou porté ou abîmé ne fera l’objet d’un échange ou d’un remboursement.
A full refund will be made unless the customer wishes to change size only. Return shipping costs are at the customer's expense.
Return procedure :

2 The customer sends the order in its original packaging (box and pouch) with the certificate of authenticity.
After receipt of the parcel and verification of the condition of the jewelry, we undertake to reimburse the customer.
These shipments remain the sole responsibility of the customer in the event of problems with the postal services.
Made-to-order creations for which the customer pays 30% for the creation and then 70% when the jewel is ready will only be reimbursed up to the amount of the 70%. The 30% deposit will not be reimbursed.
Retours internationaux – Frais de douane et de transport
En cas de retour de produit effectué depuis un territoire situé hors de l’Union européenne, dans le cadre d’un échange ou d’une demande de remboursement, l’intégralité des frais afférents au transport (frais d’expédition initiaux et de retour) ainsi que les droits de douane, taxes d’importation et tout autre frais liés aux formalités douanières demeurent à la charge exclusive du client. En aucun cas ces frais ne pourront faire l’objet d’un remboursement ou d’une prise en charge par Valkyrie Bijoux, y compris dans le cadre d’un retour conforme à nos conditions générales de vente.
Article 10 - GUARANTEES AND LIABILITIES
10.1 Défauts apparents à la réception
Lors de la livraison, le Client est tenu de vérifier l’état du produit dès sa réception.
Tout défaut apparent (par exemple : rayure, fissure, pierre abîmée, déformation, élément desserré, etc.) doit être signalé par écrit dans un délai maximum de 72 heures après réception du colis.
Passé ce délai, le produit sera réputé conforme et toute réclamation portant sur un défaut visible à la livraison ne pourra être prise en compte.
Ce délai vise à garantir un traitement rapide et équitable des réclamations.
10.2 Garantie légale de conformité
Conformément aux articles L.217-3 et suivants du Code de la consommation, Valkyrie Paris est tenue de livrer un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance du produit.
Le consommateur dispose d’un délai de deux ans à compter de la délivrance du bien pour agir en cas de défaut de conformité.
Il peut choisir entre la réparation ou le remplacement du bien, sous réserve des conditions de coût prévues par l’article L.217-9 du Code de la consommation.
Le consommateur est dispensé de rapporter la preuve de l’existence du défaut de conformité du bien durant les vingt-quatre mois suivant la délivrance du bien.
Cette garantie légale de conformité s’applique indépendamment de toute garantie commerciale éventuellement consentie.
Les dommages survenus après réception du produit (chocs, casse, usure, altération, oxydation, contact avec des produits chimiques ou abrasifs, mauvaise manipulation, etc.) ne peuvent être assimilés à un défaut de fabrication et sont donc exclus du champ de la garantie.
10.3 Entretien et utilisation
Nos bijoux sont des créations délicates nécessitant un entretien et une manipulation soigneuse.
Le Client est tenu d’en faire un usage conforme à leur nature et de respecter les conseils d’entretien disponibles sur le site.
Valkyrie Paris ne peut garantir la bonne utilisation ou la manipulation des produits par ses clients.
Une usure normale ou une patine naturelle liée au port régulier ne saurait être considérée comme un défaut de conformité.
Article 11 - PERSONAL DATA
11.1 Type of personal data collected
Valkyrie Paris undertakes to collect only personal data that is adequate, relevant and limited to what is necessary for the purposes for which it is processed. No personal data considered "sensitive", such as racial or ethnic origin, political, philosophical or religious opinions, may be requested or collected from the User.
The Customer is hereby informed that the personal data indicated as mandatory on the forms and collected for the purpose of carrying out the sale described herein. The personal data that Valkyrie Paris collects from the Customer may include :
- First and last names
- His e-mail address
- Postal address
- Phone number
- Date of birth
- Its type
11.2 Purpose of processing personal data
Personal data may be collected and used by Valkyrie Paris to enable sales, and may be transmitted to companies responsible for managing, executing and processing payment transactions. This information and data may also be kept for security and conservation purposes, in order to comply with the legal and regulatory obligations to which the Seller is subject.
The data collected may also be used as part of the management of commercial relations in order to compile statistics, carry out market and behavioral research and enable Valkyrie Paris to improve and personalize the Products.
11.3 Storage, security and confidentiality of personal data
The personal data collected is processed and stored in conditions designed to ensure its security, and is kept for the time strictly necessary to achieve the purposes set out in article 9.2 of these General Terms and Conditions. Beyond this period, it will be kept exclusively for statistical purposes and will not be used in any way whatsoever.
This data may also be stored for security and conservation purposes, in order to comply with the legal and regulatory obligations to which Valkyrie Paris is subject.
The Seller undertakes to implement technical and organizational security measures to guarantee the security, integrity and confidentiality of all personal data, in order to prevent it from being distorted, damaged or accessed by unauthorized third parties.
However, as no security measure is infallible, the Vendor cannot guarantee absolute security for the Customer's personal data.
11.4 Customer's rights to personal data
Conformément au Règlement Général sur la Protection des Données 2016/679 du 27 avril 2016 (« RGPD »), tout Client dispose d’un droit d’accès, de rectification et d’effacement des données personnelles le concernant, qu’il peut exercer directement auprès du service clients du Prestataire en le contactant à l’adresse électronique [email protected] ou à l’adresse postale suivante 22 Boulevard du Val Claret, 06600 Antibes, France, en joignant à sa demande une copie d’un titre d’identité.

Article 12 - NOTIFICATIONS
Any written notice or summons required or permitted by virtue of the provisions hereof shall be validly given if sent by hand-delivered letter or by bearer against delivery receipt, by registered mail with acknowledgement of receipt, or by electronic mail (except in the event of termination hereof), addressed to the contact details of the party concerned, each party electing domicile at its registered office.
Any change in a party's contact details for the purposes of this agreement must be notified to the other party in the manner provided above.
Notifications sent by hand or by bearer will be presumed to have been made on the date of delivery to the addressee, as attested by the delivery receipt. Notifications made by registered mail with acknowledgement of receipt will be presumed to have been made on the date of their first presentation at the addressee's address. Notifications made by e-mail will be presumed to have been made on the date the e-mail is sent.
Article 13 - AUTONOMY AND ABSENCE OF WAIVER
If any provision of these General Terms and Conditions is declared null and void or inapplicable for any reason whatsoever in application of a law, regulation or following a final court decision, it shall be deemed unwritten and the other provisions shall remain in force.
The Vendor's temporary or permanent non-enforcement of one or more of the provisions of the General Terms and Conditions shall in no event constitute a waiver.
Article 14 - MODIFICATION
Valkyrie Paris reserves the right to modify the content of these Terms and Conditions at any time for the purpose of placing new orders for Products.
Any order resulting from a modification to the General Terms and Conditions will imply acceptance by each Customer of the new version of the General Terms and Conditions, which will be communicated to them.
Article 15 - DISPUTES
The Customer is informed that he/she is free to have recourse, free of charge, to a consumer mediator for the amicable resolution of a dispute with Valkyrie Paris, in accordance with Articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code. Article 16 - APPLICABLE LAW & LANGUAGE
These General Terms and Conditions and the operations arising from them are governed by and subject to French law. They are written in French. In the event of translation into one or more foreign languages, the French text alone shall prevail in the event of dispute.
